The Neapolitan Law Firm was founded in Rome in 2019 by Professor and Lawyer Enrico Napoletano with headquarters in the prestigious Roman neighborhood of "Vittorie" in Viale Giuseppe Mazzini n. 73 and, in the process of growth and enhancement of internal resources, in 2024 it transformed into a limited liability Lawyers' Company, in compliance with art. 4-bis of the Law on Lawyers (L. 247/2012 thus introduced by art. 1, co. 141, lett. b) L. 124/2017). As such, the Firm has adopted its own Code of Ethics of Conduct and an Organization, Management and Control Model, thus conforming to the requirements of Legislative Decree 8 June 2001, n. 231 which, as is known, introduced the discipline of administrative (para-criminal) liability of legal persons.

The Firm offers its Clients accurate legal assistance both in the delicate “judicial phase” (at every level of criminal, administrative-environmental and civil-corporate proceedings) and in the fundamental “preventive consultancy phase” of the company.

The areas of legal expertise in which the Firm operates are environmental protection (Legislative Decree no. 152/06), the protection of health and safety in the workplace as well as industrial hygiene (Legislative Decree no. 81/08), construction (Presidential Decree no. 380/01), the protection of public and private assets, of the Public Administration as well as civil, corporate and bankruptcy law as well as the liability of entities (Legislative Decree no. 231/2001) and compliance.

Legal assistance in court

The Firm operates both in criminal proceedings, at all stages and levels (Court, Appeal, Cassation and enforcement) and in administrative proceedings, limited to environmental law only, as it is connected to criminal proceedings, and finally, in civil and corporate proceedings.

The services offered are:

Drafting of pro-veritate opinions;
Legal assistance in matters of environmental criminal offences (Title VI-bis of the Criminal Code “Crimes against the Environment” and Legislative Decree no. 152/06);
Legal assistance in matters of criminal offences for the protection of Health, Industrial Hygiene and Safety in the workplace (Legislative Decree no. 81/08);
Legal assistance in the simplified extinction procedure of environmental and health and safety at work fines;

Preparation and/or updating of the Internal Control System (ICS) and Internal Regulatory System (ISN): analysis of the company context, updating and preparation of Policies, General Procedures and/or Management Guidelines, Operating Instructions ;
Adoption and/or implementation of the Organization, Management and Control Model pursuant to Legislative Decree no. 231/01, coordinated for the Health and Safety at Work profiles with the requirements set out in art. 30 of Legislative Decree no. 81/08, in compliance with the ISO 45001 standard and the ISO 37001 standard for combating corruption;
Evaluation of the company's organizational structures with particular reference to the responsible parties depending on whether it is a single or multi-employer system for the purposes of any liability claims also in light of the international standard ISO 37301;

The firm specializes in preventive consultancy on environmental risks and, to this end, offers the following services:

Day-by-day environmental consultancy aimed at preventing corporate risks related to the management of the waste chain, emissions, discharges and management of authorization profiles;
Drafting of special powers of attorney and delegations of functions for the transfer of obligations and responsibilities in the environmental field;
Legal and extrajudicial advice and assistance for issues related to environmental law with particular reference to projects for the safety and remediation of a potentially or already contaminated site;
Contractual consultancy and assistance: procurement and subcontracting contracts with safeguard clauses relating to environmental law, assistance in participating in calls for tenders, assistance in drafting calls for tenders and specifications;
In-house training of environmental law and technical managers and consultancy regarding the responsibilities of the various parties involved;
Auditing activities in the main environmental matters with inspections in the workplace and industrial sectors;
Permitting activities to support the Client in the request phase for new environmental authorizations:
